Terms of Service

Acceptance

By creating an account, starting a packet check, purchasing a subscription, or otherwise using the service, you agree to these terms and the Privacy Policy. If you use the service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the service.

Independent review tool; your release responsibility

VQC Checker is independent software and is not affiliated with, sponsored by, or endorsed by Xometry. Results identify possible omissions, conflicts, or traceability risks in the evidence provided. Results are not product acceptance, customer approval, a warranty of conformity, professional engineering advice, legal or export-control advice, or a substitute for qualified inspection. You remain solely responsible for the manufactured product, inspection method, calibration, contract interpretation, regulatory compliance, submission, shipment, recall, and final release decision. You must verify the current customer and Workcenter requirements before acting on a result.

Accounts and acceptable use

You must provide accurate information, use an account you are authorized to control, and safeguard access to it. You are responsible for activity through your sign-in. You may not bypass limits, access another account, reverse engineer or disrupt the service, probe for vulnerabilities, introduce malicious files, automate abusive traffic, resell access without written permission, or use an output to misrepresent that a customer approved a part or shipment.

Your documents, permissions, and controlled data

You retain ownership of your documents. You grant VQC Checker the limited right to process submitted content only as necessary to provide, secure, and support the service. You represent that you have all rights and permissions needed to submit the content and that processing it does not violate confidentiality, privacy, intellectual-property, employment, customer, or other obligations. Do not submit classified information, prohibited personal information, or export-controlled or ITAR data unless your organization has independently confirmed that every applicable service component and provider is authorized for that data.

Packet limits and subscriptions

A packet check is counted when uploaded files begin processing. Each plan includes the displayed number of checks per calendar month; unused checks do not roll over. Paid plans renew automatically at the monthly or annual interval selected during checkout until canceled. By subscribing, you authorize Stripe and the selected payment provider to charge the displayed recurring amount and applicable taxes. Billing can be managed through the dashboard. Except where law requires otherwise, completed subscription charges are nonrefundable.

Service changes and availability

VQC Checker may add, remove, or modify rules, supported formats, provider features, plans, and security controls as requirements and technology evolve. The service may be suspended for maintenance, security, abuse, nonpayment, or legal reasons. Reasonable efforts are made to keep it available, but uninterrupted, secure, or error-free operation is not guaranteed.

Disclaimer of warranties

To the maximum extent permitted by law, the service and all outputs are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, completeness, or acceptance by any customer. VQC Checker does not warrant that it will detect every issue, correctly interpret every file, prevent a rejection, satisfy a contract, or make any product safe or conforming.

Limitation of liability

To the maximum extent permitted by law, VQC Checker and its owners, personnel, affiliates, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, business interruption, lost data, production delay, reinspection, rework, scrap, recall, chargeback, customer rejection, bodily injury, property damage, or shipment loss arising from use of or reliance on the service. To the maximum extent permitted by law, their total aggregate liability arising out of the service or these terms will not exceed the greater of (a) fees you paid to VQC Checker during the three months before the event giving rise to the claim or (b) US $100. These limits do not exclude liability that cannot legally be limited.

Your indemnity and duty to defend

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless VQC Checker and its owners, personnel, affiliates, and providers from third-party claims, damages, judgments, settlements, penalties, and reasonable attorneys’ fees and costs arising from: your documents or lack of permission to process them; products you manufacture, inspect, release, submit, or ship; your reliance on or misuse of an output; your breach of these terms; or your violation of law, export controls, privacy, confidentiality, or intellectual-property rights. VQC Checker may participate through counsel of its choice at its own expense. You may not settle a claim in a way that admits fault by or imposes obligations on a protected party without written consent.

Claims and attorneys’ fees

To the extent permitted by law, any claim arising from the service or these terms must be filed within one year after the event giving rise to it, or it is permanently barred. In any action arising from these terms, the prevailing party is entitled to recover reasonable attorneys’ fees and costs to the extent permitted by law. This is a prevailing-party provision, not a promise that filing a claim automatically makes the filing party pay the other side’s fees.

General terms

If any provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these terms without written consent; VQC Checker may assign them with the service or business. These terms and the Privacy Policy are the entire agreement about the service and supersede prior statements on that subject. Section headings are for convenience only. Provisions that by nature should survive—including ownership, disclaimers, limitations, indemnity, fee recovery, and claims—survive termination.

Changes and requests

Material changes will be posted with a new effective date or version. Continued use after the change takes effect constitutes acceptance where permitted by law. Account, billing, privacy, and service requests must be submitted through the Support section of the dashboard; replies appear in the same interface.
